Overview
The Automotive Transformation Scheme (ATS), the centrepiece of the Government’s A New Car Plan for a Greener Future, is encouraging competitive investment and innovation in the Australian automotive industry to place it on an economically sustainable footing.
The ATS was established by the Automotive Transformation Scheme Act 2009. The ATS Act 2009 can be accessed through the ComLaw website. The ATS commenced on 1 July 2010, providing assistance in the form of cash payments from 2011.
The ATS is providing assistance to registered participants for eligible investment and production. Participants are entitled to receive assistance, one quarter in arrears, subject to meeting certain conditions, for the production of motor vehicles, and for investment in research and development, to a maximum rate of 50 per cent, and investment in plant and equipment, to a maximum rate of 15 per cent.
The ATS Regulations and ATS Order are legislative instruments that contain the administrative detail of the ATS. The consultation drafts of the ATS Regulations and Order, see linked documents below, have been made available for the purposes of public consultations and are not the final legislative instruments.
ATS Regulations
The ATS Regulations contain the administrative detail of the ATS including: eligible investment and eligible production; registration under the Scheme; payments under the Scheme; transfer of registration and investment; recovery of overpayments, administrative review of decisions and transitional arrangements. The ATS Regulations 2010 can be accessed through the ComLaw website.
ATS Order
The ATS Order includes: calculating production and investment amounts; working out quarterly modulation rates and assistance to ATS participants; and the reporting requirements for the ATS. The ATS Order 2010 can be accessed through the ComLaw website.
